Consequences of Indecent Assault and Battery

If an individual touches a child under the age of 14 in an inappropriate manner, he or she may face consequences including:

  • State imprisonment for up to 10 years if the assault did not include other criminal acts like breaking and entering or kidnapping
  • Imprisonment in a house of corrections for up to 2 ½ years
  • If the assault included other criminal acts, the individual may face imprisonment for life or any term deemed appropriate by the judge and jury (not less than 10 years)
  • Following release from prison, the individual may be required to register with the state’s sex-offender registry

As with many other types of crimes, repeat offenders will typically face even more serious penalties for repeat infractions, and judges and prosecutors will typically pursue sex offenders with particular aggressiveness.
